Experienced California Employee Misclassification Defense Lawyer

A single worker label can reshape a business. When a California agency or court decides a contractor was really an employee, the fallout can reach payroll, insurance, taxes and daily operations. Back wages, penalties and lawsuits can arrive together, often with little warning.

Clifton E. Smith, a California employee misclassification defense lawyer in Oceanside, helps employers address these rules before a claim surfaces and respond when one does. California applies some of the nation’s strictest worker classification standards and CE Smith Law Firm works on the employer’s side of that challenge. Mr. Smith has been licensed in California since 1988 and brings a Human Resources and labor relations background to his work.

What Employee Misclassification Means In California

Misclassification happens when a business treats a worker as an independent contractor, but the law sees an employee. This classification matters because the law entitles employees to minimum wage, overtime pay, meal and rest breaks and workers’ compensation coverage. The law does not grant these protections to independent contractors.

California’s test changed in 2018 with the Dynamex/AB5 decision, which later wrote that approach into law. The ABC test treats a worker as an employee by default. To classify the worker as an independent contractor, the business must meet all three requirements:

  • The worker is free from the company’s control and direction
  • The work falls outside the usual course of the company’s business
  • The worker is customarily engaged in an independently established trade or business

Missing any one point means employee status. AB 2257 later refined the rules and created exemptions for certain occupations and relationships, including some business-to-business arrangements and construction subcontractors.

Each exemption carries its own conditions. For workers who qualify, courts apply the older Borello test, which weighs the overall relationship, including control, opportunity for profit or loss and skill required.

Common Misclassification Scenarios Employers Face

These disputes arise in many industries, and each case has its own issues. How the work is done each day often matters more than a job title or a signed contract.

Under Proposition 22, delivery and app-based rideshare drivers may be independent contractors if the company meets the three requirements. Other gig workers may fall under the ABC test or the Borello test, which applies in some cases. Freelancers and consultants may serve many clients. Still, a business that controls when and how it works may face a claim.

Seasonal workers face the same tests as year-round workers, even if a job lasts only a few weeks. Construction workers may fall under special rules for subcontractors. Designers and marketing consultants may qualify for an exemption if they meet its legal terms. Multi-level marketing distributors also need a close review of how the program works in practice.

Legal Risks And Penalties For Misclassification

Getting classification wrong can open several fronts at once. The California Labor Code allows state agencies and employees filing claims under PAGA to pursue civil fines ranging from $5,000 to $15,000 for each willful worker misclassification. If the employer engages in a repeated or systematic practice, the fines may increase to between $10,000 and $25,000 for each violation. Other exposure can include:

Wage and hour claims for unpaid overtime and missed meal and rest breaks

  • Workers’ compensation insurance violations
  • Unemployment insurance tax liability and Employee Development Department (EDD) audits with assessed penalties
  • Internal Revenue Service (IRS) penalties and back taxes
  • Private Attorneys General Act (PAGA) lawsuits and class action claims

These claims often overlap, so one classification decision can grow into several proceedings. A wage claim from one former worker can turn into a class action covering everyone in the same role. Even when a business prevails, the cost in time and attention can disrupt operations.

How Clifton E. Smith Helps Employers Stay Compliant

Mr. Smith approaches classification as both an attorney and a Human Resources and labor relations professional, so the guidance he gives accounts for legal rules and daily management realities.

Proactive compliance strategies

Prevention is usually less costly than a defense. Mr. Smith can help employers with worker classification audits that review each role against the ABC and Borello tests. He can draft or update independent contractor agreements, train managers and HR staff on classification risks and build documentation that reflects how workers actually perform the work. Regular reviews help catch drift as roles and duties change.

Defense when claims arise

When a claim arrives, timing matters. Mr. Smith represents employers in responding to EDD audits, contesting Division of Labor Standards Enforcement (DLSE) determinations and defending lawsuits in court. Every situation is different and results depend on the circumstances. Early steps, such as gathering records and preparing a clear response, often shape how a claim develops.
