Employer compliance with the Americans with Disabilities Act

One of the many responsibilities of California employers is to ensure that employees enjoy a work environment that is free from discrimination and harassment. As part of this effort, employers will need to ensure they are doing everything possible to adhere to the Americans with Disabilities Act. If you own a business or manage a company, adherence to the ADA is critical for the protection of certain employees and your own interests.

Preventing discrimination in any form is a critical endeavor for all employers. This is about much more than just avoiding issues that could subject you to litigation, but it is also about providing any disabled employees with a work environment in which they can do their jobs comfortably and effectively. By focusing on accessibility and employing other strategies, you can comply with the ADA and possibly avoid complications.

Steps to ADA compliance

Avoiding lawsuits related to disability discrimination requires you to focus on how you can best comply with the terms of the Americans with Disabilities Act. Effective ways to do this in your place of business include:

  • Follow the correct processes when assessing the needs of the employee and determining whether reasonable accommodations are necessary.
  • Carefully document everything regarding employee accommodations, accessibility and other matters pertaining to the ADA.
  • Consider digital accessibility, as well as the physical ways your space needs to be accessible to all employees.
  • Treat all disabled employees with respect and as individuals, remembering that there is no one-size-fits-all approach to ADA adherence.
  • Avoid assumptions about an employee’s disabilities, as well as any types of behavior that may be considered discriminatory in nature.
